​​​​2025-26 Snow Removal Agreement 

 

This Agreement is entered into by and between the Client and Liberty Lawn and Snow (referred to as the Contractor) for snow removal services at the Client's property (referred to as the Property).

​

 

I. Contract Scope and Term

 

Contract Period: November 1, 2025 – March 31, 2026

​

Unlimited Service Visits: This contract includes unlimited service visits within the Contract Period. There is no cap on the number of snow events or the total volume of snow covered under this Agreement.

​

Unlimited Snow Totals: There is no cap on the total amount of snow included within the Contract Period.

​

Auto-Renewal: For Client convenience, this Agreement will automatically renew annually under the listed terms unless canceled as specified in the Termination section.

​

Acceptance of Terms: This Agreement is provided in all snow quote emails. The Client agrees that accepting an estimate and/or sending email correspondence requesting service constitutes valid and legal acceptance of all terms listed herein, without requiring a separate signature capture.

​

Christmas Clause (Service Pause): To allow employees time with their families, the Contractor reserves the right to pause service operations during the following times:

  • Christmas Eve: 4:00 PM (1600 hours) until midnight (0000 hours).

  • Christmas Day: 6:00 AM (0600 hours) until noon (1200 hours).

​

 

II. Service Initiation and Execution​

​

Snowfall Trigger:   

 

The service trigger is 1.5 inches of new snow accumulation during a single snowfall event.

​

  • Obligation Initiated: When the accumulated new snowfall reaches 1.5 inches, the Contractor is obligated to service the Property (the "Trigger").

  • Measurement: Snowfall is measured per event by the Contractor at various locations within the service area at pavement level, excluding snow drifts. Individual property measurements are not practical or necessary. Multiple snow events that produce accumulations less than the trigger cannot be combined.

  • Client Responsibility: The Client remains responsible for maintaining the Property between snowfalls of less than 1.5 inches.

Snow Removal Schedule:

​

  • Service Commencement: Although the service obligation begins at the 1.5-inch trigger, the Contractor will begin dispatching equipment and initiating full route service only when snowfall has completely ceased OR when the total accumulation reaches 6 inches, whichever occurs first.

  • The Contractor will strive to complete rounds of service for every additional 6 inches of snow accumulation during the storm.

  • Completion Guarantee: The Contractor guarantees driveway service completion within 16 hours of service commencement (i.e., after the storm has ceased or reached 6 inches). Typically, routes are completed within 8 hours.​

  • Blizzard/Large Snowfall:  Completion Guarantee will be null and void if snowfall totals exceed 8"  or blizzard like conditions occur.

​

Shoveling Services: Hand shoveling of garage aprons or walkways is not included in this contract.

​

City Plow Windrows: The Contractor is not responsible for snow left behind by city plows if the total snowfall accumulation for that event was under 6 inches.

  • Excessive Snow: If the city plow deposits excessive snow (windrows) on an event with total accumulation of 6 inches or more, the Contractor will remove it at no additional charge.

  • Chargeable Removal: City plow windrow removal for events under 6 inches or callbacks requested to remove snow resulting from vehicles parked in the driveway will be billed at a minimum rate of $50 per occurrence.

 

III. Client Responsibilities and Requirements

 

Signage Requirement: To ensure timely service, Liberty will place a 4-inch by 4-foot sign along the driveway for the entire Contract Period. Services will not be provided if the required sign is absent.

​

Snow Stake Requirement: Unless the Client contracts for the Contractor's Snow Staking service, the Client is responsible for driveway snow staking using flexible fiberglass snow stakes.

  • The Client must stake out all structures, including electrical boxes, light posts, and water mains, even if staking service was contracted.

​

Obstacle Removal: Before every snow event, the Client must ensure all vehicles, garbage cans, electrical cords and obstructions are cleared from the driveway.  In addition, basket ball hoops must remain in their upper most position.  Failure to do so may result in incomplete or fully skipped service visit with no refund.   

 

IV. Fees and Payment

 

Card on File: All residential clients must place a credit card on file for payments.

​

Contract Invoicing: The Client's card will be charged for the total price of the annual contract on October 15th. A paid invoice will be emailed to the Client.

​

Outside of Contract Invoicing: The Client's credit card will be charged, and a paid invoice will be emailed following the service visit.

​

Past Due Accounts: Contractor reserves the right to suspend services until full payment is received. The Client agrees to reimburse the Contractor for all administrative costs, legal fees, and associated expenses in the event of default or collection action.

​

Out-of-Contract Snow Removal: Snow removal required outside the Contract Period (November 1 – March 31) will be performed at a discounted rate of $40 per visit. These services remain subject to all terms of this Agreement.

​

Salting Services: The Contractor may determine that salting services are necessary. If mandated, the Client will be charged a fee of $60 per application.

 

V. Liability and Damage

 

Property Damage: The Client must report any property damage caused by the Contractor in writing within 96 hours of the incident. If property damage is not reported timely and properly, the Contractor will have no obligations, and the Client waives any right to damages.

  • Contractor is not responsible for any damages caused by ice or snow buildup that remains on the Property.

  • In the event of damage caused by slippery conditions, the Client is not responsible for damages to the Contractor's equipment (trucks, plows, blowers, etc.).

Limitations of Contractor Liability: The Contractor is not responsible for:

  • Damage to any objects that are snow-covered or not visible.

  • Damage to irrigation heads; the Client is responsible for ensuring sprinkler heads are properly seated before the winter season.

  • Damage to items left on driveways, walkways, or steps (these areas must be clear).

  • Damage to downspouts, planters, basketball hoops, or other items within the driveway area that were not removed for the season.

  • Damage to turf, landscaping, or irrigation components caused by the piling or plowing of snow.

  • Scraping, chipping, or stains left from snow removal on pavement caused by uneven concrete, lips, edges, or other surface irregularities. (This is considered normal wear.)

  • Personal injuries or death resulting from slips, falls, or other accidents occurring on the Property.

  • Snow remaining due to vehicles parked in hazardous or obstructive areas.

  • Ice accumulation or snow removal resulting from roof clearing or drainage issues.

​

Hazard & Bare Pavement: The Client understands that snow removal may not clear the Property to bare pavement, and slippery conditions may remain. The Contractor is not responsible for any death, injury, loss, or damage to persons or property resulting from the non-performance of obligations due to unsafe conditions.

​

Blizzard Clause: The Contractor reserves the right to limit or suspend services (without penalty) during severe cold, poor visibility, or when local government plows are taken off the roads to avoid unsafe working conditions.

 

VI. General Provisions

 

Licensure and Insurance: The Contractor represents that it and its agents will maintain proper licensure for services and holds General Liability Insurance and workers' compensation coverage.

​

Force Majeure: The Contractor shall not be held liable for delays, damages, or claims resulting from events beyond its reasonable control, including but not limited to severe weather, war, strikes, material shortages, or acts of third parties.

​

Termination: This agreement is cancelable at any time with 7 days' written notice by either the Client or Contractor.

  • Refund Calculation: Mid-contract cancellations will result in a pro-rated refund, calculated based on the unused portion of the contract fee minus all service visits rendered up to the termination date, calculated at a rate of $60 per service visit.
